Whatever the cause of your road traffic accident; another road user, poorly maintained road surfaces or obstructions in the road, if the accident wasn’t your fault and an injury was sustained, you could be entitled to make a claim for compensation. Road traffic accident claims (RTAs) cover any accident that happens on the road. Common claims include:
Who pays my compensation?
It is against the law to drive without insurance and it is the insurance company of the person who caused the accident, who pays your compensation. This means you can still make a claim for compensation even if the person who caused the accident is a family member or friend, without them being personally liable for your compensation payout.
Uninsured or untraced drivers
Unfortunately, there are a number of motorists who break the law by not possessing this insurance. If you are involved in an accident with an uninsured driver, or a hit and run driver, a claim for compensation can still be made using the Motor Insurers’ Bureau (MIB). This is an organisation set up to help victims of accidents involved in such incidents.
