Preparing for a Second Marriage

Second marriages often come with more complicated circumstances than the first. Those entering into second marriages may have acquired significant assets, or a business, that they want to protect in the event of a divorce. Individuals with children from previous relationships have additional issues to consider.

Before entering into a second marriage it is wise to take advice before the marriage takes place. A prenuptial agreement can help identify what each is bringing to the relationship and, when drafted fairly and properly, can be very persuasive evidence in the event of a divorce.

With a second marriage, ensuring you have a valid and up-to-date will in place is also very important. Marriage invalidates any previous will made unless it was made in contemplation of that marriage. Once married, your new spouse has automatic rights to a proportion of the estate which may not reflect your wishes, particularly where children from a previous relationship are involved.
